KM Payment Rules

1. Provider and scope

These Terms of Service (the "Terms") govern the use of the Shopify app "KM Payment Rules" (the "App") provided by KEVIN METZDORF LTD, 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, registered in England and Wales under Companies House number 16972608 (the "Provider"). Contact: info@kevin-metzdorf.com.

The App is offered exclusively to businesses (B2B) operating a Shopify store — not to consumers. By installing the App through the Shopify App Store, the merchant accepts these Terms.

2. Subject of the service

The App lets the merchant define rules for how payment methods are presented in Shopify checkout: hiding payment methods, changing their order or renaming them — depending on conditions such as cart total, shipping country, customer tags, products or the selected shipping method. The rules are executed as a Shopify Function ("payment customization") on Shopify's platform. The current feature set follows from the App description in the Shopify App Store and the Provider's product page.

The App controls only the visibility, order and labels of payment methods. It is not a payment provider, does not process payments and changes neither prices nor payment terms.

3. Technical requirements and limits

Use of the App requires a Shopify store on the current Shopify checkout (Checkout Extensibility). Which payment methods can be hidden, reordered or renamed is determined by Shopify: for example, payment methods with a logo (including PayPal, Klarna, Shop Pay, Apple Pay, Google Pay) cannot be renamed, wallets cannot be reordered, and payment customizations do not apply to draft orders or point of sale. Shopify also limits the number of active payment customizations per store. These constraints are outside the Provider's control and may be changed by Shopify.

4. Trial, pricing and billing

Use of the App is billed as a monthly subscription through Shopify Billing as part of the merchant's Shopify invoice; Shopify's billing terms apply. The price and any trial period are shown in the Shopify App Store and inside the App before the subscription is confirmed. The Provider charges no usage-based fees.

Price changes are announced through Shopify's designated mechanisms and take effect only with the merchant's consent or under the rules of Shopify Billing.

5. Term and termination

The agreement runs for an indefinite period and can be ended by the merchant at any time by uninstalling the App; no separate notice is required. On uninstallation, Shopify removes the payment customizations created by the App; checkout then shows all active payment methods in the default order again. For billing of periods already started and any pro-rated credits, the rules of Shopify App Billing apply. The Provider may discontinue operation of the App with reasonable advance notice.

6. Availability

The App is provided "as is". No specific availability is warranted. By design, the rules run on Shopify's platform; the App's admin interface is operated in a European data centre. If the admin interface is temporarily unreachable, rules that are already active remain in effect at checkout.

7. Merchant obligations

The merchant is responsible for configuring the rules correctly, for verifying the payment methods shown at checkout, and for all obligations towards their end customers — in particular for ensuring that the payment methods offered and their labels comply with the pricing, payment and consumer-protection rules applicable to their store.

8. Liability

The Provider is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In cases of simple negligence, the Provider is liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the agreement possible in the first place), limited to the foreseeable damage typical for this type of agreement and capped at the fees paid by the merchant for the App in the preceding twelve months. Liability for lost profits and indirect damage is excluded in cases of simple negligence. Mandatory statutory liability remains unaffected.

9. Support

Support is provided by email at info@kevin-metzdorf.com — on business days, with a reply usually within one to two business days, in English or German. There is no legal entitlement to specific response times.

10. Privacy

Information about the processing of personal data by the App can be found in the App's Privacy Policy.

11. Changes to these Terms

The Provider may amend these Terms with effect for the future, for example when the App's features change or legal requirements do. The merchant will be informed of material changes in text form (e.g. by email or inside the App). Continued use of the App after the changes take effect constitutes acceptance of the amended Terms.

12. Final provisions

These Terms are governed by the laws of England and Wales, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory provisions of the law at the merchant's seat remain unaffected. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
